Man charged with drunk driving following fatal accident

As most drivers are aware, driving at night can be more difficult due to reduced visibility. In some cases, it may be more difficult for drivers to stop in time to avoid unexpected obstacles in the roadway, because they may be unable to see them in time to avoid a collision. Unfortunately, one man is accused of drunk driving in Louisiana following a recent crash involving an allegedly drunk man lying in the road.

The alleged incident occurred at approximately 3 a.m. on a day in May. Reports indicate that a 34-year-old male was lying in the road. Unfortunately, he was reportedly struck by a pickup truck driven by a 49-year-old man.

The younger man passed away as a result of injuries suffered in the collision. Police suspect that both men were under the influence of alcohol. A breath test was reportedly administered to the driver and revealed a blood alcohol content of .085. Blood tests have been sent to the state lab. The driver now faces multiple charges, including negligent homicide and driving while intoxicated.

While tools such as Breathalyzers are utilized to determine whether a person has been engaged in drunk driving, they are, unfortunately, fallible. Mistakes in administration and calibration can result in inaccurate results, potentially resulting in wrongful arrests. As a result, the man charged in this case will likely want to ensure that the equipment used was working properly and that the test was properly administered. A Louisiana criminal defense attorney with experience with such cases can examine the details of the case and help create an appropriate defense.
